Welcome to OpenTracker! These Terms govern your use of the OpenTracker mobile application ("App") provided by Desteba Productions, S.L. ("we," "us," "our").

By downloading, installing, or using OpenTracker, you agree to these Terms. If you don't agree, please don't use the App.

1. THE BASICS

OpenTracker is a GPS tracking application for iOS, iPadOS, and watchOS. It's designed for outdoor activities, personal safety, and professional use cases like fleet management.

The App is free to download and use (version 1.0). Future versions may include optional paid features.

2. LICENSE TO USE

We grant you a personal, non-exclusive, non-transferable, revocable license to use OpenTracker for personal or commercial purposes.

3. YOUR RESPONSIBILITIES

GPS Accuracy GPS relies on satellites and can be affected by weather, buildings, tunnels, and other factors. Accuracy varies (typically ±5-20 meters). Don't rely solely on GPS for life-or-death navigation.

Safety First

Don't use the App while driving unless hands-free
Pay attention to your surroundings during outdoor activities
Emergency features (SOS) complement but don't replace emergency services (call 112/911 directly in emergencies)
GPS can fail - always have backup navigation

Battery Management
Background GPS tracking consumes battery. Monitor your battery level during long activities.

Data Responsibility
You're responsible for:

Any data you send to your own servers
Securing your device (passcode, biometric lock)
Backing up important tracks (we recommend iCloud or regular exports)
Compliance with local laws regarding GPS tracking and data

4. PRIVACY & DATA

Your data stays on your device. We don't collect, store, or process your personal information. See our Privacy Policy for details: opentracker.xierra.app/privacy

If you use optional features (iCloud, live sharing, custom servers), different privacy considerations apply - see Privacy Policy.

5. LIVE LOCATION SHARING

When you create a live sharing session:

You generate a unique, private link
Anyone with the link can see your real-time location
Sessions expire after your chosen duration (1-72 hours)
Data is automatically deleted after expiration
You can stop sharing anytime

Important: Treat sharing links like passwords. Anyone with the link can track you. Only share with people you trust.

6. AR WAYPOINTS & CONTENT

User-Generated Waypoint Collections
You can create and share waypoint collections (.otwaypoint files). You're responsible for:

Accuracy of waypoint locations
Not creating waypoints on private property without permission
Not creating offensive or inappropriate waypoint names/descriptions
Respecting local laws and regulations

We're not responsible for waypoint collections created by others.

7. APPLE WATCH APP

The Watch app can function independently (standalone GPS tracking) or as a remote control for the iPhone app. Some features require iPhone connectivity. Battery life varies based on usage.

8. THIRD-PARTY SERVICES

Apple Maps
Map data is provided by Apple. Apple's terms apply to map usage.

iCloud (Optional)
If you enable iCloud sync, Apple's terms and privacy policy apply.

Your Servers (Optional)
If you configure custom endpoints, you're responsible for your server's security, privacy, and compliance with laws.

9. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The App is provided "AS IS" without warranties of any kind, express or implied, including but not limited to:

Accuracy of GPS data
Uninterrupted or error-free operation
Fitness for a particular purpose
Compatibility with future iOS versions

We don't guarantee:

GPS will work everywhere (it won't - tunnels, buildings, bad weather affect it)
The App will prevent accidents or emergencies
Data won't be lost (back up important tracks!)
Third-party services will always work

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We're not liable for:

Accidents, injuries, or deaths during outdoor activities
Lost, damaged, or corrupted data
Battery drain or device issues
GPS inaccuracies or navigation errors
Failed emergency features or SOS alerts
Decisions made based on App data
Third-party service failures
Any indirect, incidental, or consequential damages

Our total liability shall not exceed €50 or the amount you paid for the App (€0 for free version), whichever is greater.

Some jurisdictions don't allow these limitations, so they may not apply to you.

11. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any laws or third-party rights
Data you send to your own servers
Waypoint collections you create or share

12. COMPLIANCE WITH LAWS

GPS tracking laws in your jurisdiction
Privacy laws (GDPR, CCPA, etc.) if tracking others
Employment laws if using for fleet management
Export control laws
Traffic laws (no phone use while driving)

Some jurisdictions regulate GPS tracking (especially of employees or family members). Know your local laws.

13. EXPORT CONTROLS

The App uses encryption and may be subject to export control laws. You agree not to export or re-export the App to prohibited countries or persons.

14. INTELLECTUAL PROPERTY

OpenTracker, XIERRA, and associated logos are trademarks of Desteba Productions, S.L.

The App's code, design, and content are protected by copyright and other intellectual property laws. All rights reserved.

Your GPS tracks and waypoints are YOUR property. We claim no ownership.

15. UPDATES & CHANGES

We may update the App with new features, bug fixes, or improvements. Updates may be automatic or require manual installation.

We may modify these Terms at any time. Material changes will be notified in the App. Continued use after changes means you accept the updated Terms.

16. TERMINATION

You can stop using the App anytime by deleting it.

We may terminate or suspend your access if you violate these Terms, though since there are no accounts, this is mostly theoretical.

Upon termination:

Your license to use the App ends
Data on your device remains yours (export it before deleting!)
Shared waypoint collections remain valid

17. DISPUTES & GOVERNING LAW

These Terms are governed by the laws of Spain (where we're based), without regard to conflict of law principles.

Any disputes shall be resolved in the courts of Alicante, Spain, or through binding arbitration if required by your local laws.

European Union residents have additional rights under EU consumer protection laws.

18. SEVERABILITY

If any provision of these Terms is found unenforceable, the rest remains in effect.

19. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Desteba Productions, S.L. regarding the App.
